NuArtis Wildlife Terms of Service

                                           Last Updated: September 23, 2026

OVERVIEW

Welcome to NuArtis Wildlife.

The terms “NuArtis Wildlife,” “we,” “us,” and “our” refer to NuArtis Wildlife and, where applicable, the legal entity operating the business.

NuArtis Wildlife provides a curated art, ecommerce, and customer experience through our website, sales pages, shopping cart, checkout systems, and related services, content, features, tools, products, and communications collectively referred to as the “Services.”

Our primary website and certain sales experiences are operated through ClickFunnels. Certain products and transactions use Shopify for shopping cart, checkout, order administration, customer accounts, and related ecommerce functions. Certain transactions may also be processed through Stripe, Shopify Payments, PayPal, Apple Pay, Google Pay, Shop Pay, or other payment providers.

Regardless of the technology or platform used to complete a transaction, purchases of NuArtis Wildlife products are made from NuArtis Wildlife and not from Shopify, ClickFunnels, Stripe, or another technology provider.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They include important provisions concerning orders, artwork, intellectual property, warranties, liability, and dispute resolution.

By visiting, accessing, interacting with, purchasing through, or otherwise using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence or that you have the legal authority necessary to enter into this agreement.

To browse, purchase, create an account, or otherwise use certain Services, you may be asked to provide information including your name, email address, billing information, shipping address, telephone number, and payment information.

You represent that information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of any customer-account credentials and for activity occurring through your account.

You may not sell, assign, transfer, or license your customer account to another person without our written consent.

SECTION 2 — ARTWORK AND PRODUCTS

NuArtis Wildlife makes reasonable efforts to accurately describe and represent its artwork and other products.

However, digital images, photographs, room mockups, videos, and other visual representations may not precisely reproduce the appearance of a finished artwork.

Colors, contrast, texture, detail, scale, framing, and other visual characteristics may vary depending on:

      • Your monitor, display, browser, or device.
      • Lighting conditions.
      • Printing and production processes.
      • Canvas, paper, framing, and other materials.
      • Normal manufacturing tolerances.

Room scenes, lifestyle images, and wall mockups may be used to illustrate approximate scale and presentation and should not be interpreted as precise architectural measurements unless expressly stated.

We do not warrant that a finished artwork will appear identical to its digital representation.

Limited Editions.

Certain NuArtis Wildlife works may be offered as limited editions.

Where an artwork is described as a limited edition:

      • Availability is subject to the stated edition size.
      • Edition numbers may be assigned according to our fulfillment procedures.
      • Certain works may include a Certificate of Authenticity or other edition documentation.
      • Once an edition is sold out, we are under no obligation to produce additional copies
represented as part of that same edition.

We reserve the right to modify or discontinue products, materials, formats, framing options, sizes, packaging, or other specifications at any time, provided that confirmed orders are fulfilled substantially in accordance with the description applicable when the order was accepted.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase the applicable product.

We reserve the right to accept, decline, limit, or cancel an order for reasons including:

      • Product availability.
      • Pricing or listing errors.
      • Suspected fraud or unauthorized payment activity.
      • Shipping restrictions.
      • Production limitations.
      • Errors in customer or payment information.
      • Other legitimate business reasons.

An order is not considered accepted until payment has been successfully authorized or processed and we have confirmed the order.

Please review orders carefully before submitting them. Because some artwork may be produced, framed, prepared, or allocated specifically for an order, cancellation requests may not always be possible after an order has entered production or fulfillment.

If we cancel or materially change an order, we will attempt to notify you using the email address, telephone number, billing information, or other contact information provided with the order.

Purchases are subject to our applicable Refund or Return Policy as presented on our website, checkout, sales page, or order documentation.

Unless we expressly authorize otherwise, products are offered for personal or household use and not for unauthorized commercial resale.

SECTION 4 — PRICING, PAYMENT, AND BILLING

Prices, discounts, promotional offers, and product availability may change without notice.

The price charged for an order will generally be the price displayed when the order is submitted, subject to correction of genuine errors.

Unless expressly stated otherwise, displayed prices may not include:

      • Sales or use taxes.
      • Shipping or handling charges.
      • Customs duties.
      • Import taxes.
      • Brokerage fees.
      • Other governmental assessments.

Certain NuArtis Wildlife purchases may be processed through Shopify and Shopify Payments, while other purchases may be processed through ClickFunnels and Stripe.

Additional payment options may include PayPal, Apple Pay, Google Pay, Shop Pay, or other payment methods made available at checkout.

By providing payment information, you represent and warrant that:

      • The information is accurate and complete.
      • You are authorized to use the selected payment method.
      • Charges incurred through the transaction may be submitted to the applicable payment
        provider.
      • You agree to pay all authorized amounts associated with the order, including applicable
taxes, shipping, and other disclosed charges.

Full payment-card credentials are generally collected and processed by our payment processors rather than stored directly by NuArtis Wildlife.

SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless we expressly state otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

      • Shipping carriers.
      • Weather.
      • Customs.
      • Transportation interruptions.
      • Labor disruptions.
      • Natural disasters.
      • Government actions.
      • Supply shortages.
      • Incorrect customer information.

Customers are responsible for providing a complete and accurate shipping address.

Where permitted by applicable law, risk of loss transfers to the customer when the product is delivered to the applicable carrier for shipment.

Nothing in this section limits rights that cannot lawfully be waived under applicable consumer-protection laws.

If an artwork arrives visibly damaged, please retain the product and packaging and contact us promptly so that we can evaluate the shipping claim and available remedies.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their contents, including artwork, images, compositions, photographs, videos, text, graphics, logos, trademarks, product names, collection names, designs, page layouts, audio, and other creative materials, are owned by NuArtis Wildlife or used under license and are protected by United States and international intellectual-property laws.

Purchase of a physical artwork does not transfer copyright or other intellectual-property rights in the underlying artwork.

Unless we expressly agree otherwise in writing, purchasing an artwork gives you ownership of the purchased physical copy only.

You may not, without prior written permission:

      • Reproduce an artwork.
      • Digitize or scan an artwork for commercial use.
      • Create or sell reproductions.
      • Create derivative commercial products.
      • Use artwork in advertising or merchandise.
      • License, distribute, publish, or commercially exploit the artwork or its imagery.
      • Remove or misrepresent copyright, edition, signature, certification, or attribution
        information.

The Services are provided for personal, noncommercial use unless we expressly authorize another use.

“NuArtis,” “NuArtis Wildlife,” related logos, collection names, product names, slogans, and branding may be trademarks or proprietary identifiers of NuArtis Wildlife and may not be used without permission.

All rights not expressly granted are reserved.

SECTION 7 — THIRD-PARTY TOOLS AND SERVICES

Our Services may rely upon or provide access to tools and functionality supplied by third parties, including ecommerce platforms, hosting providers, payment processors, analytics providers, shipping providers, email providers, and marketing services.

Examples may include Shopify, ClickFunnels, Stripe, Shopify Payments, PayPal, Apple Pay, Google Pay, Cloudflare, and analytics and advertising platforms.

Third-party services may be governed by their own agreements and policies.

We do not control all aspects of third-party services and are not responsible for outages, errors, interruptions, security events, or acts of third-party providers except to the extent required by law.

Use of optional third-party tools is at your discretion and may be subject to separate terms.

SECTION 8 — THIRD-PARTY LINKS

The Services may contain links to third-party websites, platforms, or resources.

We are not responsible for evaluating or guaranteeing the content, accuracy, availability, security, privacy practices, products, or services offered through third-party websites.

If you leave our Services to access another website or platform, you do so at your own discretion.

Questions or complaints regarding third-party products or services should generally be directed to the applicable third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY AND OTHER COMMERCE PLATFORMS

Certain NuArtis Wildlife ecommerce services are powered by Shopify.

Where you make a purchase using a Shopify-powered cart or checkout, the purchase is made directly from NuArtis Wildlife and not from Shopify.

Shopify provides technology that enables us to offer certain ecommerce functionality but is not the seller of NuArtis Wildlife artwork.

To the fullest extent permitted by law, Shopify and its affiliates are not responsible for injuries, damages, losses, product claims, fulfillment obligations, or other liabilities arising from products purchased from NuArtis Wildlife.

Certain other NuArtis Wildlife experiences may be operated using ClickFunnels, Stripe, or other third-party technology platforms.

Use of those technologies does not change the identity of NuArtis Wildlife as the seller unless expressly stated otherwise.

SECTION 10 — PRIVACY

Our collection, use, disclosure, and processing of personal information is governed by the NuArtis Wildlife Privacy Policy:

https://www.nuartiswildlife.com/privacy-policy

Depending on how you interact with our Services, your information may also be processed by Shopify, ClickFunnels, Stripe, payment providers, analytics services, advertising platforms, and other service providers.

These providers may have their own privacy policies.

By using our Services, you acknowledge that information necessary to provide website, ecommerce, payment, fulfillment, analytics, security, and other functionality may be transmitted to third-party service providers.

SECTION 11 — FEEDBACK, REVIEWS, AND SUBMISSIONS

If you voluntarily submit reviews, comments, testimonials, ideas, suggestions, feedback, photographs, or other materials to us (“Feedback”), you represent that you have the right to provide them.

Unless otherwise agreed in writing, you grant NuArtis Wildlife a nonexclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and distribute Feedback in connection with operating, improving, and promoting our business and Services.

You represent that Feedback will not:

      • Violate another party’s intellectual-property rights.
      • Violate privacy or publicity rights.
      • Be defamatory or unlawful.
      • Contain malicious software.
      • Misrepresent its source.
      • Contain materially false or misleading claims.

We have no obligation to publish or retain Feedback and may remove Feedback where permitted by law.

      • Pricing.
      • Availability.
      • Promotions.
      • Shipping,
      • Production details.
      • Transit times.
      • Other product information.

We reserve the right to correct errors, update information, or cancel orders affected by material errors, subject to applicable law.

You may not use the Services to:

      • Violate applicable law.

We reserve the right to restrict, suspend, or terminate access where we reasonably believe these Terms have been violated.

SECTION 14 — AUTOMATED AGENTS

Automated agents must not:

      • Conceal their automated nature.
      • Circumvent technical restrictions or CAPTCHAs.
      • Misrepresent themselves as human users.
      • Circumvent security, rate limits, access restrictions, or robot-exclusion measures.
      • Scrape, reproduce, or systematically extract protected content without authorization.

We may restrict or block automated access at our discretion where permitted by law.

SECTION 15 — TERMINATION

We may restrict, suspend, or terminate your access to all or part of the Services where permitted by law, including for violations of these Terms, misuse of the Services, security concerns, fraud, or other legitimate business reasons.

You remain responsible for amounts lawfully due before termination.

Provisions that by their nature should survive termination will remain effective, including provisions regarding:

We do not warrant that:

      • The Services will always be uninterrupted.
      • The Services will be error-free.
      • Digital representations will precisely match physical artwork.

Nothing in these Terms excludes statutory consumer rights that cannot legally be waived.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, NuArtis Wildlife and its owners, officers, directors, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or related to:

      • Your use of the Services.

      • Purchases made through the Services.
      • Third-party service interruptions.
      • Loss of data.
      • Lost profits or revenue.
      • Unauthorized access.
      • Errors or omissions in content.

This limitation applies regardless of the theory of liability and even if we were advised that such damages might occur.

Some jurisdictions do not permit certain exclusions or limitations, in which case those exclusions or limitations apply only to the maximum extent permitted by law.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless NuArtis Wildlife and its affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable legal expenses arising from:

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent legally permissible and the remaining provisions will continue in effect.

SECTION 20 — WAIVER; ENTIRE AGREEMENT

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with incorporated policies and any additional terms expressly applicable to a particular product, transaction, or promotion, constitute the agreement governing your use of the Services.

SECTION 21 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
